By downloading, installing, or using Rock Identifier ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

Rock Identifier is a mobile application that uses artificial intelligence to identify rocks, minerals, crystals, and gemstones from photographs. The App also provides estimated market values, educational content, and collection management features.

While we strive to provide accurate rock and mineral identifications, the App uses AI technology that may not always be 100% accurate. Identifications and value estimates are provided for informational and educational purposes only.

Important: Value estimates are based on analysis of web listings and market data. They should not be considered professional appraisals. For valuable specimens or important decisions, we recommend consulting a certified gemologist or geologist.

5. Subscription and Payments

Rock Identifier offers premium features through auto-renewable subscriptions:

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID account settings.

Payment is charged to your Apple ID account at confirmation of purchase. Refunds are handled by Apple according to their refund policies.

6. Intellectual Property

The App, including its content, features, and functionality, is owned by Rock Identifier and is protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of photos you take with the App. By using the identification feature, you grant us a limited license to process your photos for the purpose of providing the identification service.

Your use of Rock Identifier is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO WARRANTIES REGARDING THE ACCURACY OF IDENTIFICATIONS OR VALUE ESTIMATES PROVIDED BY THE APP.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROCK IDENTIFIER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

We are not responsible for any decisions you make based on identifications or value estimates provided by the App.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
